Welcome to Eric Thorsen Gallery. These Terms & Conditions apply to your use of ericthorsengallery.com and to any purchase you make from us online, by phone or in our gallery. By using this site or placing an order, you agree to these terms. If you have questions, please contact us before ordering.

1. About Us

2. Our Artwork

Each bronze sculpture is cast and finished by hand. Because patinas are applied by hand and every casting is individual, color, texture and finish will vary slightly from piece to piece and from the photos on our website. Photos are representative, and screen colors vary between devices. Listed dimensions are approximate.

Many of our sculptures are limited editions. Edition sizes are listed on the product page when available, and we reserve the right to limit quantities.

3. Prices and Payment

All prices are in U.S. dollars and do not include shipping or applicable taxes unless stated. Prices and availability may change without notice. If a product is listed at an incorrect price because of an error, we may cancel the order and refund any payment, or contact you to confirm the correct price before we proceed.

Pre-cast pricing: New sculptures may be offered at an introductory “pre-cast” price for a limited time. When you buy at the pre-cast price, you are purchasing a finished, patinaed limited-edition bronze based on the original clay sculpture shown. The finished bronze may differ slightly from the clay image.

Payment is due when you place your order unless we agree otherwise in writing.

4. Orders and Production Time

Your order is accepted when we confirm it. We may decline or cancel an order at our discretion, for example if an item is unavailable, and will refund any payment in full.

Many sculptures, including new releases, are cast and finished by hand once ordered. Please allow up to 12 weeks for production before your order ships. We will keep you updated on your piece’s progress. Production times are estimates and can vary with the size and complexity of the work.

5. Commissions and Custom Work

Commissions, custom sculptures, gates, doors, mantels, enlargements and other custom projects are governed by a separate written agreement covering design, scale, materials, pricing, payment schedule and timeline. If that agreement differs from these terms, the commission agreement applies.

6. Shipping

We generally ship with USPS, UPS or FedEx. Tracking information is emailed when your order ships. Faster shipping options are available; please contact the gallery to arrange them. Orders shipping outside the U.S. and Canada require special arrangements, so please contact us before ordering.

Please inspect your order on arrival and notify us immediately if anything is damaged in transit, keeping all packaging, so we can help with a claim.

7. Returns and Refunds

Returns are handled under our Shipping & Returns policy. In short, please contact us before sending anything back. Buyers are responsible for return shipping costs and for the risk of loss or damage in transit, and items must be returned in their original condition. Commissioned and custom works are not returnable unless agreed in writing.

8. Copyright and Use of Images

All artwork, sculptures, photographs, text and other content on this website are © Eric Thorsen and Eric Thorsen Gallery, unless otherwise noted, and are protected by copyright law. Buying an original sculpture or print gives you ownership of that physical object. It does not transfer copyright or the right to reproduce, copy, cast, scan or commercially use the artwork or its images.

Digital 3D models and files are licensed only under a separate written license agreement, which sets out whether the rights are exclusive or non-exclusive and how the files may be used.

You may share links to our pages and post personal photos of artwork you own. Please contact us for permission for any other use of our images or content.

9. Using This Website

Please use this website lawfully. You agree not to misuse the site, interfere with its operation, attempt to gain unauthorized access, or copy its content for commercial purposes. Links to other websites are provided for convenience; we are not responsible for their content or practices.

Your personal information is handled as described in our Privacy Policy.

10. Limitation of Liability

This website and its content are provided “as is.” To the fullest extent permitted by law, Eric Thorsen Gallery is not liable for any indirect, incidental or consequential damages arising from your use of the website or your purchase. Our total liability for any claim related to a purchase will not exceed the amount you paid for that item. Nothing in these terms limits any rights you have under applicable consumer protection law.

11. Governing Law

These terms are governed by the laws of the State of Montana, USA, without regard to its conflict-of-law rules.

12. Changes to These Terms

We may update these Terms & Conditions from time to time. Changes take effect when posted on this page. The terms in effect when you place an order apply to that order.
